By accessing FuckTubly.com (hereinafter "the Site"), operated by FuckTubly (hereinafter "we", "our"), you agree to be bound by these Terms of Service (hereinafter "the Terms"). If you do not accept these Terms in their entirety, you must not access the Site or use our services. These Terms constitute a legally binding agreement between you and FuckTubly.
Access to the Site is strictly restricted to persons aged at least 18 years old, or who have reached the age of majority in their jurisdiction if it is higher than 18. By accessing the Site, you represent and warrant under penalty of prosecution: - That you are at least 18 years old or the legal age required in your country - That accessing adult content is legal in your jurisdiction - That you are accessing the Site of your own free will and for your personal use We reserve the right to implement age verification measures in compliance with applicable laws, including the EU Digital Services Act (DSA) and national legislation in force.
When creating your account, you agree to provide accurate and up-to-date information. FuckTubly allows verified creators to upload content. By uploading content, you represent and warrant: - That you are the owner or legal rights holder of this content - That all persons appearing in the content are at least 18 years old and have given their explicit written consent - That you maintain age verification and consent documents in compliance with 18 U.S.C. 2257 - That the content does not infringe any third-party intellectual property rights - That the content does not contain illegal material, including but not limited to: content involving minors (CSAM), non-consensual content, revenge porn, pornographic deepfakes We reserve the right to remove any content and suspend any account in case of violation, without notice.
The following are strictly prohibited on the Site: - Any content involving minors (zero tolerance, immediate reporting to authorities) - Any non-consensual content, including revenge porn and deepfakes - Harassment, threats, or intimidation of other users - Hate speech, discrimination, or incitement to violence - Spam, phishing, or any attempted fraud - Attempting to bypass security measures or age verification - Unauthorized downloading, redistribution, or sharing of content - Using bots, scrapers, or automated tools to access content - Any illegal activity under applicable law
FuckTubly respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). As a platform hosting user-generated content, we benefit from the DMCA safe harbor provisions (17 U.S.C. 512). - We have a designated DMCA agent to receive notifications - We enforce a repeat infringer termination policy - Notifications and counter-notifications are processed in accordance with legal procedures For any claims, please see our dedicated DMCA page.
In compliance with the Digital Services Act (Regulation (EU) 2022/2065), FuckTubly implements content moderation measures: - Reporting mechanism accessible to all users - Review and processing of reports within 24 to 72 hours - Notification to affected users when action is taken on their content - Cooperation with competent authorities upon request - Publication of a transparency report in accordance with DSA obligations Any reported illegal content will be promptly removed in compliance with hosting obligations.
We reserve the right to suspend or terminate your account in case of violation of these Terms, without notice or refund. Grounds include: - Violation of prohibited content rules - Repeated copyright infringement (repeat infringer policy) - Payment fraud or attempted fraud - Behavior harmful to the community You may terminate your account at any time by contacting us. Data deletion will be performed in accordance with our Privacy Policy and GDPR.
FuckTubly is provided "as is" and "as available". To the extent permitted by applicable law: - We do not guarantee that the service will be uninterrupted or error-free - We are not responsible for content uploaded by users - Our total liability is limited to the amount you have paid in the last 12 months - We are not responsible for indirect, incidental, or consequential damages These limitations do not apply where prohibited by law, including under European consumer protection law.
You agree to indemnify and hold harmless FuckTubly, its officers, employees, and partners from any claims, losses, or damages (including attorney's fees) arising from: - Your use of the Site - Violation of these Terms - Violation of third-party rights - Content you have uploaded to the Site
These Terms are governed by French law. For users located in the European Union, mandatory consumer protection provisions of your country of residence also apply. Any dispute shall be submitted to the competent courts of Paris, France, subject to mandatory jurisdiction rules in favor of consumers. If any provision of these Terms is found invalid, the remaining provisions shall remain in effect.
We may modify these Terms at any time. Changes become effective upon publication on the Site. For substantial changes, we will notify you by email at least 30 days in advance. Your continued use of the Site after modification constitutes acceptance of the new Terms.
